Dein Boss hat dir gesagt, du bist gekündigt? Tja, so reicht das leider nicht….

Laut Kündigungsschutzgesetz muss eine Kündigung immer schriftlich erfolgen. Wenn dein Arbeitgeber dir nur sagt, dass du gekündigt bist oder dass er dich kündigen will, ist das keine rechtskräftige Kündigung. Dein Arbeitsverhältnis ist dann immer noch ungekündigt und besteht nach wie vor. Ein Arbeitsverhältnis ist erst dann beendet, wenn 1. entweder du oder dein Arbeitgeber eine schriftliche Kündigung ausgesprochen hat und 2. auch erst nach der Kündigungsfrist. Innerhalb dieser Frist hast du nach wie vor Anspruch auf deinen Lohn oder Urlaub. Oder wenn du dich mit deinem Arbeitgeber auf 3. einen Aufhebungsvertrag geeinigt hast – hier ist aber Vorsicht geboten, denn oftmals verzichtet man mit einem Aufhebungsvertrag auf sämtliche Ansprüche wie z.B. eine Urlaubsabgeltung. Ein Aufhebungsvertrag kann außerdem eine Sperrzeit beim Arbeitslosengeld bedeuten. Deshalb solltest du nie sofort einen Aufhebungsvertrag unterschreiben, sondern dich rechtlich bei deiner Gewerkschaft NGG beraten lassen. Wenn du eine Kündigung erhältst (die du übrigens nicht unterschreiben muss!), mit der du nicht einverstanden bist, hast du die Möglichkeit, innerhalb von drei Wochen nach Zugang Kündigungsschutzklage zu erheben. Und auch wenn du selbst kündigen willst, sichere dich vorher rechtlich ab. Auch hier unterstützt dich deine Gewerkschaft NGG

Your boss told you, you´re fired? Well, that’s legally not enough…

Regarding to the german Kündigungsschutzgesetz (Employment Protection Act) a dismissal has to take place in written form. Always. It is no legally binding dismissal if your employer just tells you that you are fired or that he wants to fire you. Your employment is still regularly employed and does still exist in this case. An employment is finished if one of this 3 things happen: 1. either if you or your employer dismiss in written form and 2. even if, there is a notice period to hold on. During this period, you still have claims like salary or holiday. 3rd thing to end an employment would be if you arrange about an agreement to terminate a contract with your employer. But attention! In a lot of agreements like this there are phrases that say that you resign your claims like holiday payment. It´s also possible that you will get an off-time regarding unemployment compensation. Because of this you never should sign an agreement like this without looking to your union NGG for legally advise. And if you receive a dismissal (which you never have to sign!) with which you disagree you have the opportunity to take action against this within three weeks. And if you want to dismiss by yourself, first check legally rules – also with the support of your union NGG.
